Educational Objectives:

In this workshop, you will learn how to:

  • Identify what to do if you are served with a Subpoena.
  • Review some lesser-known dual relationship issues concerning court appearances and document production by therapists who never planned to be involved in court work.
  • Explain the ethical requirement for every therapist to have a Practice Will and a general plan if something were to happen to the therapist. Each participant will be given a Practice Will Package as part of this workshop created by the presenters along with instructions regarding how to complete it.
  • Define and assess subtle boundary issues that occur when therapists engage in “helping too much” by going over time, making special accommodations, advice-giving, self-disclosure, seeing the friends or family of clients, etc.
  • Describe the ethical requirements around the termination of clinical services to avoid abandonment and reduce liability, particularly when the therapist wants to or needs to initiate the termination.
  • Explain the legal side of risk management strategies throughout the workshop, including the four elements of malpractice and what to do if served with a lawsuit or faced with a Licensing Board complaint.
  • Analyze where we stand with COVID-19 at this point and what ethical and legal obligations we have going forward as the pandemic becomes more of an endemic. COVID Disclaimer/Informed Consent Included.

Workshop Description:

This workshop will address several ethical topics that seem to be particularly relevant to therapists right now based on how many questions Dr. Beaton-York and Mr. York have been receiving regarding these “hot topics.” They will address ethical issues that have emerged such as the importance of having a plan if something were to happen to the therapist, also known as a Practice Will. Together, the presenters have created a Practice Will template from both an ethical and legal perspective that will be included as part of this workshop. They will also walk you through the steps of implementing your Practice Will. Dr. Beaton-York will define other subtle boundary issues that occur when therapists engage in “helping too much” by going over time, making special accommodations, advice-giving, self-disclosure, seeing the friends or family of clients, etc. Mr. York will address what questions could arise in court around varying from normal protocol and how to consider such questions ahead of time to avoid being in court at all. Dr. Beaton-York will define some lesser-known dual relationship issues concerning court appearances and document production by therapists who never planned to be involved in court work. Presented by: Becky Beaton-York, Ph.D.

Dr. Beaton-York has 33 years of experience in the therapy field, and she has run her own businesses for 25 of those years. She was the Founder of The Anxiety & Stress Management Institute, a very large practice with over 40 self-pay clinicians when she sold it after just eight years. She is the Co-Founder of the nonprofit OCD Georgia, Inc., and the founder of The Knowledge Tree, LLC. She loves growing businesses and coaching therapists regarding practice-building from an ethical perspective. In 2005, Dr. Beaton-York was voted Counselor Educator of the Year by the Licensed Professional Counselor's Association of Georgia. She is currently an Adjunct Professor in the Department of Psychology at Emory University. Dr. Beaton-York is also the Chair of the Georgia Psychological Association’s Ethics Committee. You may have also seen her on the television series "Hoarding: Buried Alive" as the treating psychologist on over 60 episodes.

Chris J. York, Esq.

Mr. York attended Bowdoin College in Maine for undergrad and is a 1991 graduate of Emory University Law School. As an Atlanta-based litigator, early in his career he tried numerous medical malpractice jury trials on behalf of defendant physicians. Later, he focused more on product liability, business, and corporate practice. He was Georgia counsel to a national seat belt and airbag supplier and later served as Senior VP and General Counsel to an Atlanta medical device company. In 2003, he formed his own firm which he still runs. His law partner, Chip Gaskill, is a Vanderbilt Law School graduate who specializes in corporate matters in addition to family law, trusts, and estates. Their firm is York Gaskill, LLC. Today, Mr. York primarily specializes in helping small businesses, with several of his clients being therapy practice owners.
